An affidavit by former President Donald Trump, entered into the Georgia election case against him, claims that cell phone data proves Fulton County District Attorney Fani Willis and special prosecutor Nathan Wade spent nights together as early as September 2021, suggesting their relationship began months earlier than Willis and Wade claimed in court.
The data would also directly contradict testimony by Wade during the hearing to determine if Willis should be disqualified from the Georgia election case against Trump due to their relationship. Wade has earned more than $650,000 since Willis appointed him, and the couple shared luxurious vacations he purchased using his company credit card.
In Trump’s filing, his attorney asks to include as a defense exhibit an affidavit by defense investigator Charles Mittelstadt, who analyzed cell phone data obtained from AT&T to determine that Wade’s phone signal made contact with “one of the two towers” close to Willis’ home “for an extended period of time on 35 occasions during the period ranging from April 1, 2021 to November 30, 2021.”
Additionally, Mittelstadt wrote that his analysis showed Wade (pictured above, right)arriving at Willis’ home on September 11, 2021, at nearly 11 p.m. and leaving at almost 3:30 in the morning, then sending a text message to Willis at 4:20 a.m.
On November 30 2021, Mittelstadt claims Wade received a phone call from Willis (pictured above, left) at 11:32 p.m. that lasted for 40 minutes, then left just after midnight and arrived at Willis’ home before 1 a.m. He further claims that Wade stayed at Willis’ address until 4:55 a.m the next morning.
Mittelstadt explained in his affidavit that he compiled the data into a PowerPoint presentation for potential review in court.
During his February 15 testimony, Wade claimed there could be no cell phone location data showing him in the same location as Willis until their relationship commenced, which he and Willis claim occurred in early 2022.
Steve Sadow, the attorney who represents Trump in Georgia, questioned, “So if phone records were to reflect that you were making phone calls from the same location as [Willis’] condo before November 1, 2021 and it was on multiple occasions, the phone records would be wrong?”
Wade confirmed his stance that any phone records placed him at Willis’ home before November 1, 2021, when he started work on the Trump case for Willis.

The latest filing comes as about half of Americans say defense attorneys have provided sufficient evidence for Willis to be disqualified from the case against Trump. Just 39 percent of those surveyed said Willis should remain on the case.
Fulton County Superior Court Judge Scott McAfee was reported to be holding an in-camera review of evidence and testimony, which remains sealed to the public, on Friday, and arguments for Willis’ disqualification are scheduled for March 1.
McAfee will then need to make a ruling. Legal pundits have suggested the judge is unlikely to rule from the bench and will instead determine Willis’ fate in a written ruling that may come days after hearings conclude.
